User Agreement

By visiting, accessing, or using  https://skylinecrypto.com.tr   (the “Website”), you (“User” or “You”) consent to this Privacy Policy (“Privacy Policy”). This Privacy Policy forms part of, and is subject to the provisions of, the Terms of Service (available at https://skylinecrypto.com.tr ). This Privacy Policy constitutes an agreement and understanding between you (the User) and the Skyline Crypto regarding the use (processing) of your Personal Data (defined below) as the Foundation provides you (the User) with the access to the Website and the Services offered on the Website. 

 

1. Definitions 

 

1.1 The words in the table below shall have the following meanings attributed to them:
Digital Assets (also called “convertible virtual currency,” “cryptocurrency,” or “digital goods”)    Any digital asset which is based on the cryptographic protocol of a computer network that may be (i) centralized or decentralized, (ii) closed or open-source, and (iii) used as a medium of exchange and/or store of value. Furthermore, a Digital Asset is expressed as a unit; capable of being transferred, stored, and traded on a peer-to-peer basis with or without conditions or limitations. Digital Assets also include NFTs and other digital collectibles.
Personal Data    Any information relating to an identified or identifiable natural or legal person, such as a name, address, email address, phone number, date of birth, an identification number, location data, an online identifier or any other information that is unique to that individual natural or legal person.

 

2. Collected Personal Data 

 

2.1 The Foundation collects, processes, and stores Personal Data collected from the User via the User’s use of the Website or the Services provided on the Website. This Personal Data is not limited to and may include such information as, for example, contact details, email address, mobile phone number, nationality, date of birth, residential address, copies of identification documentation provided by the User or derived from publicly accessible databases, information relating to the User’s device or internet service (such as an IP address and a MAC number, network activity information), corporate legal name, incorporation/registration information, as well as any additional Personal Data or documentation at the discretion of the Foundation. 

2.2 The Foundation may collect Personal Data from customers located in the European Economic Area (“EEA”). The Foundation requests explicit consent for the transfer of Personal Data from the EEA to outside of the area. If the User is an individual located in the EEA and the User declines to consent to such transfer, the User will no longer be able to use the Website and the Services provided on the Website.

 

3. Use of the Personal Data 

 

3.1 The Foundation uses Personal Data to communicate with the User and to administer, deliver, improve, and personalize the Service(s) provided on the Website. The Foundation may also generate generic data out of any Personal Data it collects and uses for its own purposes. The Foundation may also use such data to communicate with the User in relation to other products or services offered by the Foundation. The Foundation does not share the User’s Personal Data with third parties except where the User has given its consent and further detailed below. 

3.2 The Foundation may share the User’s Personal Data with third parties: 
(a) If the Foundation thinks that sharing it is necessary to enforce the Terms of Service; 
(b) To comply with requests from Competent Authorities around the world, including regulators, law enforcement and/or justice departments (see the Terms of Service); 
(c) When the Foundation is compelled to do so by a subpoena, court order, or similar legal procedure in any applicable jurisdiction(s) (see the Terms of Service); 
(d) To comply with any relevant laws and regulations in any applicable jurisdiction(s); 
(e) To third parties who provide services to the Foundation (such as administration or technical services); 
(f) To third parties in the event the Foundation might sell or buy other businesses or services (in such transactions, user information generally is one of the transferred business assets). 

3.3 The Foundation has also implemented international standards to prevent money laundering, terrorist financing and circumventing trade and economic sanctions and will implement applicable Digital Asset laws and regulations in any applicable jurisdiction(s) when effective, which may require the Foundation to undertake due diligence on its Users. This may include the use of third-party data and service providers which the Foundation may cross-reference with the User’s personal information. 

 

4. Storing Personal Data 

 

4.1 The data that the Foundation collects from the User may be transferred to, and stored at, a destination outside of the place of registration of the Foundation. It may also be processed by staff operating outside of the place of registration of the Foundation who work for the Foundation or for one of Foundation’s suppliers. By submitting Personal Data, the User agrees to this transfer, storing or processing, except customers located in the EEA, as detailed above. All information you provide to us is stored on our and/or third party cloud servers. 

 

5. Access, correction and deletion of personal data 

 

5.1 The User has the right to obtain a copy of its Personal Data upon request and ascertain whether the information the Foundation holds about the User is accurate and up-to-date. If any of the User’s Personal Data is inaccurate, the User may request to update its information. The User may also request to delete its Personal Data, with exception that the Foundation may refuse the deletion request in certain circumstances, such as compliance with relevant laws and regulations. For data access, correction, or deletion requests, please contact the Foundation through the contact form available on the Website with the subject “data inquiry”. 

5.2 In response to data access, correction, or deletion request, the Foundation will verify the requesting User’s identity to ensure that it is legally entitled to make such a request. While the Foundation aims to respond electronically to these requests free of charge, the Foundation reserves the right to charge the User a reasonable fee should the User’s request be repetitive or onerous. 

5.3 Digital wallet addresses created by the Foundation on each registered user’s behalf cannot be deleted from the blockchain networks for technical reasons. Therefore, the Foundation is unable to delete this information. 

 

6. Marketing 

 

6.1 The User agrees that the Foundation may communicate company news, promotions and information relating to the Website or the Services provided on the Website to the User. The Foundation may share the User’s Personal Data with third parties to help the Foundation with its marketing and promotional projects, or sending marketing communications. 

6.2 Users can opt out from these marketing communications at any moment. If the User does not want to receive these communications, it shall send an email through the contact form available on the Website to the Foundation. 

6.3 Users cannot opt out of receiving communications related to Terms of Service, updates made to additional terms/agreements specific to each Service (for the list of provided Services see Clause 3 of the Terms of Service) or any other operational notifications and updates. 

 

7. Cookie usage 

 

7.1 While the User accesses the Website, the Foundation may use the industry practice of placing in the User’s browser a small amount of data (Cookies) on the User’s device through which the User accesses the Website. This information help the Foundation recognize the User, collect information about the User’s use of the Website to better customize its services and improve the User’s experience. The Foundation may also use the information collected to ensure compliance with its compliance program, and to ensure the User’s account security has not been compromised by detecting irregular or suspicious account activities. 

8. Information security 

8.1 The Foundation endeavors to protect the Website and the User from unauthorized access, alteration, disclosure, or destruction of Personal Data that the Foundation collects and stores. The Foundation take various measures to ensure information security, including encryption of the Website’s communications with various protocols and software; required two-factor authentication for all sessions; periodic review of the Personal Data collection, storage, and processing practices; and restricted access to the Personal Data on a need-to-know bases for its employees who are subject to strict contractual confidentiality obligations. However, even with all these precautions, the Foundation cannot fully guarantee against the access, disclosure, alteration, or deletion of data through events, including but not limited to hardware or software failure or unauthorized use. Any information that the User provide to the Foundation is done so entirely at the User’s own risk (see also Clause 10 Risk disclosure & due diligence of the Terms of Service). 

 

9. Changes to this Privacy Policy 

 

9.1 The Foundation reserves the right to change or modify these Privacy Policy at any time and at its sole discretion. The Foundation will provide notice of these changes by posting the revised Privacy Policy and changing the "Last updated" date at the top of the Privacy Policy. Any changes or modifications will be effective immediately upon posting the revisions to the Website. These changes will apply at that instant to all then current and subsequent users of the Website.
